Terms & Conditions
The following terms apply to all memberships, passes, apps and any goods or services you purchase from Scottie’s Pilates (ABN 88 044 531 833)
Definitions
Scottie’s Pilates Management means Scottie’s Pilates Founder Kristin Scott
Scottie’s Pilates website means our online platform of www.scottiepilates.com
Billing Cycle means a fourteen (14) day period whereby at its conclusion payment will be direct debited from a client’s nominated account.
Membership Week means the seven (7) day period of time for class participation beginning on the first day of your Billing Cycle.
Glofox App means the online application entitled ‘Glofox’ available for both apple and android phone users.
New Clients means persons whom have never participated in any Scottie’s Pilates classes or held any type of membership.
Please note all capitalised terms in this Agreement not defined above are otherwise defined on the Pricing Page of the Scottie’s Website. Clients should view the pricing page for further information available at www.scottiespilates.com/pricing
Acceptance of Agreement
This Agreement sets forth legally binding terms for your use of any of Scottie’s services. If you do not accept the terms of this Agreement, you should leave the Scottie’s Studio and discontinue use of our services immediately.
We may modify this Agreement from time to time, and when we do, we shall send the new Agreement via email. Any such modification shall be immediately effective. It is your responsibility to review your emails and this Agreement regularly.
By accepting this Agreement, you confirm you are at least sixteen (16) years of age and are fully able and competent to enter into and comply with this Agreement. If you are between sixteen (16) and eighteen (18) years of age your parent or guardian must provide a completed Parental Consent Form to Scottie’s Pilates Management before the commencement of your first class.
COVID-19 Considerations
Scottie’s Pilates’ Responsibilities
Scottie’s Pilates confirms it is regularly monitoring to Federal and State Government’s updates on the coronavirus and we are following the guidance of the Department of Health to ensure that you are able to safely attend our studio.
For your peace of mind and safety we keep our studios sterilised and clean thoroughly after every class in accordance with the guidelines of NSW Health and Safe Work Australia. Hand sanitiser is accessible at our venue entry and throughout our studio. Scottie’s Pilates will continue to be vigilant with its hygiene standards after COVD-19.
Client’s Responsibilities
By attending a class, you confirm the following:
(a) You are not experiencing any symptoms including:
(b) You have not been diagnosed with COVID-19 in the last 7 days
Introductory Pass Validity
(a) An Introductory Pass is available for New Clients only;
(b) The offer for an Introductory Pass is valid for fourteen (14) days from a client’s first class;
(c) No refunds, transfers, suspensions or extensions are offered on unused portions of this offer.
Class Pass Validity
Casual Classes are valid for one (1) month after the initial sale date;
(1) Five (5) Class Passes are valid for three (3) months after a client’s first visit using the pass;
(2) Ten (10) Class Passes are valid for six (6) months after a client’s first visit using the pass.
Class Pass purchases are non-exchangeable, non-refundable or non-transferable. We are unable to refund, exchange or transfer any unused portions of class passes.
Essential and Unlimited Memberships
Essential Membership Holders can attend a maximum of two (2) classes per week.
Unlimited Membership Holders can attend unlimited classes per week.
Bookings and Cancellations
Class sizes are limited, therefore we strongly recommended that you pre-book your class via the Scottie’s Pilates Website or Glofox App.
If you are unable to make the class you are booked in to, please cancel the class via the Scottie’s Pilates Website or Glofox App at least three (3) hours prior to the class start time. The following penalties apply if this does not occur:
(a) Essential or Unlimited members who fail to cancel more than three (3) hours before, more than once per 14 day period will incur a $15 fee. No shows will automatically incur a $15 fee.
(b) Casual, five (5) or ten (10) class pass holders who fail to cancel more than three (3) hours before, or don’t show up to a booked class will be charged for the class.
Membership Billing
Payment Terms
Payments are processed via direct debit every fourteen (14) days for unlimited memberships and every seven (7) days for essentials memberships. Please note that any unused classes do not rollover to the following week.
If you use a debit or credit card (including VISA debit facilities) we will add a surcharge to your fortnightly debit no greater than the cost of accepting that payment method from our external third-party provider.
Your membership will automatically renew. If you do not wish for the contract to renew, simply email hello@scottiepilates.com for this to be arranged.
GST
All fees include goods and services tax (GST). Your fees will change in line with any government GST rate changes.
Issues with Payment
If you query a payment, we will do our best to respond within seven (7) days. If you are not happy with our response, you may contact your financial institution. It will handle your query in line with its own policy.
If you do not fully pay your fees on the due date, we will suspend your membership until your payments are up to date and you have given us your account details. We will also charge you a late payment fee of $10 for a failed payment. This will be debited from your account, and you authorise us to do this.
Client Responsibilities
(a) You must make sure:
Membership Suspensions
Suspensions can be made for a minimum period of fourteen (14) days and a maximum period of three (3) months over a twelve (12)-month period.
If you would like to suspend your membership, please email us at hello@scottiespilates.com with seven (7) days notice.
Cancelling Memberships
Scottie’s Pilates has no minimum term before you are able to end your membership. If you wish to cancel your membership, you must email hello@scottiespilates.com at least seven (7) days prior to your next scheduled payment.
Please note that memberships are paid in advance, and no refunds can be offered if we have not been given seven (7) days notice. You are however able to attend the studio up until the end of your last Billing Cycle.
Scottie’s Pilates reserves the right to immediately terminate a client’s membership following any breach of the Terms and Conditions, and no refund will be made under such circumstances.
Returns & Refunds
Class Pass purchases and memberships are non-exchangeable, non-refundable or non-transferable. We are unable to refund, exchange or transfer any unused membership periods or class passes.
General Terms
Scottie’s Pilates has the right to change:
(a) teachers;
(b) conditions of memberships;
(c) conditions of Class Passes;
(d) hours of operation;
(e) services offered; and
(f) pricing;
at its discretion with reasonable notice. You will be notified of these changes via email.
Client Details
You agree to:
(a) provide true, accurate, current and complete information about yourself as prompted; and
(b) promptly inform Scottie’s Pilates Management of any changes to contact information, credit card details, or any other relevant information.
Glofox App
In order to receive promotional material and newsletters, you must opt in via the Glofox App. To do this, simply log into your Glofox account and update your preferences in your personal profile.
Allowing us to use your image
We sometimes film or photograph the studio so it is possible you will appear in the background. By signing this Agreement, you allow us to use your image in promotional and other business-related material.
Jurisdiction
This Agreement shall be governed by and interpreted according to the laws of NSW.
Waiver and Severability of Terms
The failure of Scottie’s Pilates to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.
Privacy Statement
Scottie’s Pilates adheres to the National Privacy Principles in the Privacy Act 1988 (Cth) in order to ensure that all personal information is handled securely.
By providing your personal information to Scottie’s Pilates, you consent to Scottie’s Pilates maintaining, recording, and using that information to improve service to customers.
The types of personal information that we collect may include any or all of the following:
(a) name, address, telephone number and other contact details;
(a) date of birth and driver’s license number (to comply with age restrictions);
(b) credit card details; and/or
(c) bank account details.
Personal information held is generally stored in our server, which has security requirements aimed at eliminating unauthorised access to or loss of personal information.
Scottie’s Pilates will collect personal information for any or all of the following purposes:
(a) to create a relationship between the client and Scottie’s Pilates;
(b) to register you for any promotions;
(c) to provide the classes requested and keep a record of any transactions; and/or
(d) to assist Scottie’s Pilates to make our services useful to you.
Personal information that is collected may be used within reasonable expectations or disclosed where permitted by law.
The Scottie’s Pilates Website uses cookies and related technologies in order to personalise and operate the website. Cookies may also be used to target ads to you through our website. A cookie is a piece of information that allows the server to verify and cooperate more effectively with your device.
Our website may include links to other websites and products. The links are embedded for advertising, informational or accessibility purposes.
Access to personal information will be granted if proof of identity is given. If you wish to access your personal information or have an inquiry about privacy, please contact Scottie’s Pilates.
Scottie’s Pilates will take reasonable steps to destroy your personal information when we no longer need it.
